1.0 Introduction
- (1) This Advisory Circular (AC) is provided for information and guidance purposes. It describes an example of an acceptable means, but not the only means, of demonstrating compliance with regulations and standards. This AC on its own does not change, create, amend, or permit deviations from regulatory requirements, nor does it establish minimum standards.
1.1 Purpose
- (1) The purpose of this document is to provide guidance on the application process for an Approved Maintenance Organization (AMO) certificate and any amendments or changes following approval.
1.2 Applicability
- (1) This document applies to Transport Canada Civil Aviation (TCCA) personnel, delegates, and the aviation industry.

2.3 Definitions and abbreviations
- (1) The following definitions are used in this document:
- (a) Applicant: a person or organization that applies for an AMO certificate.
- (b) Approved Maintenance Organization: means a natural person or a legal entity holding an AMO certificate authorizing the performance and release of maintenance performed on any aeronautical product for which they are approved.
- (c) Approved Maintenance Organization Certificate: a document issued to indicate a maintenance organization is approved to perform and certify maintenance on the specified aeronautical product for which they are approved.
- (d) Documents Incorporated by Reference: with respect to the Maintenance Policy Manual (MPM), means documents such as forms or detailed company procedures which are referenced in the MPM of the AMO.
- (e) Maintenance Policy Manual: an approved manual that contains information to ensure the efficiency of an AMO’s maintenance policies and meets the manual requirements in Standard 573 – Approved Maintenance Organizations.
- (f) Safety Management System: a documented process for managing risks that integrates operations and technical systems with the management of financial and human resources to ensure aviation safety or the safety of the public.
- (2) The following abbreviations are used in this document:

3.0 Background
- (1) An applicant for an AMO certificate is required to demonstrate to the Minister that they meet the requirements of the Canadian Aviation Regulations (CARs), that they are adequately equipped for the proposed AMO certification, and that they perform maintenance in accordance with the prescribed standards and procedures. The following sections describe the application and amendment process for an AMO certificate and TCCA’s expectations from the applicant.
4.0 Application for a new AMO certificate
4.1 Pre-application phase
4.1.1 Initial contact with TCCA
- (1) An applicant who wishes to apply for an AMO certificate should contact the TCCA regional service centre where the AMO will be located. You will be put in contact with a Civil Aviation Safety Inspector (CASI) who can answer questions about the application process and provide additional information if required.
- (a) An applicant for an AMO certificate may be a company who is already the holder of an Air Operator Certificate (AOC) or is a Flight Training Unit (FTU) and may wish to start their own AMO. In this case the operator would contact their Principal Maintenance Inspector (PMI) and inform them of their intentions to apply for an AMO certificate.
4.1.2 Application submission requirements
- (1) The following list of items should be in place prior to submitting an application to TCCA and are described in detail in the subsequent sections below:
- (a) Appoint an Accountable Executive;
- (b) Appoint a Person Responsible for Maintenance;
- (c) Assign a Quality Assurance Manager (if applicable);
- (d) Create a Maintenance Policy Manual;
- (e) Create a Safety Management System (if applicable);
- (f) Assign a Safety Management System Manager (if applicable);
- (g) Fill out Form 24-0070, Application for Approval of a Maintenance Organization; and
- (h) Pay fee for issuance of a certificate of approval for a maintenance organization.
4.1.3 Accountable Executive
-
(1) The applicant for an AMO certificate shall appoint an individual as Accountable Executive (AE). The AE must meet the requirements of Subsection 106.02(1) of the CARs.
Note: If the certificate holder is the holder of more than one certificate, only one AE may be appointed to be responsible for the activities under the certificates.
- (2) The AE will be responsible for the activities authorized under the certificate and accountable on their behalf for meeting the requirements of the Regulations.
- (3) No person shall be appointed AE unless they have control of the financial and human resources that are necessary for the activities authorized under the certificate.
- (4) For additional information on choosing an AE and accepting the responsibilities, refer to Selection of an Accountable Executive on the Transport Canada website.
- (5) The AE must submit to the Minister a signed statement that they accept the responsibilities of their position within 30 days of their appointment. The letter must be received prior to issuance of the AMO certificate.
4.1.4 Person Responsible for Maintenance
-
(1) An applicant shall appoint a Person Responsible for Maintenance (PRM), whose responsibilities and functional duties encompass those set out in Section 573.04 of the CARs and Section 573.04 of the Standard.
Note: If the applicant already holds an AOC or an FTU and is adding an AMO to their operations, the positions of PRM and Person Responsible for the Maintenance Control System (PRMCS) shall be held by the same person.
- (2) The applicant is required to ensure the person appointed PRM meets the following criteria:
- (a) The PRM shall have acquired a minimum of six years experience in the performance or direct supervision of maintenance activities of the type undertaken by the organization, with a minimum of six months obtained within the preceding two years;
- (b) If they are not the holder of a valid Canadian Aircraft Maintenance Engineer (AME) licence, they are required to complete an open book examination that demonstrates knowledge of the provisions of the CARs; and
- (c) The PRM does not, at the time of their appointment or during their tenure, have a record of conviction for an offence under Section 7.3 of the Act or two or more offences under any of Sections 571.10 and 571.11 not arising from a single occurrence.
- (3) The PRM may assign management functions for specific tasks to another person if the assignment and scope are detailed in the MPM. The responsibility of the PRM does not change after the assignment of management functions.
- (4) The PRM shall submit to the Minister a signed statement that they accept the responsibilities of their position within 30 days of their appointment. The signed statement must be received prior to issuance of the AMO certificate.
4.1.5 Quality Assurance Manager
- (1) The PRM may choose to assign a specific person as the Quality Assurance (QA) Manager to oversee the entire Quality Assurance program depending on the size and complexity of the organization.
- (2) The PRM may assign this management function to another person if:
- (a) The person has successfully completed an open book examination that demonstrates knowledge of the provisions of the CARs, or they are the holder of an AME licence;
- (b) The person has acquired a minimum of six years experience in the performance or direct supervision of maintenance activities of the type undertaken by the organization, at least six months of which have been obtained within the preceding two years;
- (c) The person does not have a record of conviction for an offence under section 7.3 of the Act or two or more offences under any section of Section 571.10 and 571.11 of the CARs not arising from a single occurrence; and
- (d) The assignment and scope of the QA Manager are described in the MPM.
- (3) The QA Manager will be responsible for establishing and maintaining a quality program as required by Subsection 573.09(1) of the CARs, however the PRM holds the ultimate responsibility under the AMO certificate.
4.1.6 Maintenance Policy Manual
- (1) An applicant is required to establish an MPM that contains information to ensure the efficiency of the AMO’s maintenance policies.
- (2) The MPM shall contain the information described in Section 573.10 of the Standard.

(a) The Minister may authorize the applicant to have Documents Incorporated by Reference (DIR). This allows the organization to carry out changes to their documents or procedures without having to submit them for approval with each change. The DIR should not contradict the Regulations.
Note: Though not approved by TCCA, the DIRs should be available to the PMI.
- (3) For guidance on creating an MPM, refer to Transport Canada Publication (TP) 14308E, TCCA Guidelines: Maintenance Policy Manuals.
- (4) After a draft MPM is completed, applicants may refer to TP 14428, MPM Checklist, to confirm that the proposed MPM meets the regulatory requirements prior to submitting it for approval.
4.1.7 Safety Management System
- (1) If the AMO will be performing maintenance on aircraft operated under CAR 705, Airline Operations, a Safety Management System (SMS) will need to be established as required by CAR 107 and CAR 573 Division II.
- (2) The SMS program shall meet the requirements of Section 107.03 and Section 573.31 of the CARs and be under the control of the PRM of the AMO.
- (3) Guidance for the creation of an SMS program can be found in AC 107-001, Guidance on Safety Management Systems Development or AC 107-002, Safety Management System Development Guide for Smaller Aviation Organizations.
- (4) The details of the SMS program should be contained in the MPM.
4.1.8 SMS Manager
- (1) The PRM may choose to assign a specific person as the SMS Manager to oversee the entire SMS program depending on the size and complexity of the organization.
- (2) The PRM may assign this management function to another person if:
- (a) The person has successfully completed an open book examination that demonstrates knowledge of the provisions of the CARs, or they are the holder of an AME licence;
- (b) The person has acquired a minimum of six years experience in the performance or direct supervision of maintenance activities of the type undertaken by the organization, at least six months of which have been obtained within the preceding two years;
- (c) The person does not have a record of conviction for an offence under Section 7.3 of the Act or two or more offences under any section of Section 571.10 and 571.11 of the CARs not arising from a single occurrence; and
- (d) The assignment and scope of the responsibilities of the SMS Manager are described in the MPM.
- (3) The SMS Manager will be responsible for establishing and maintaining an SMS program as detailed in Subsection 573.31(1) of the CARs, however the PRM holds the ultimate responsibility under the AMO certificate.
4.1.9 Application form
- (1) Complete Form 24-0070, Application for Approval of a Maintenance Organization.
- (2) The applicant may refer to the detailed instructions to complete each field of Form 24-0070. In addition, the applicant may refer to Appendix A – Guidance for completing Form 24-0070 for examples of ratings and limitations in reference to a category.
- (a) The applicant is required to have a registered legal business name, and the name must match the legal name entered on Form 24-0070.
4.1.10 Fee payment
- (1) An applicant for an AMO certificate is required to pay a fee.
- (2) TP 14984, Transport Canada Civil Aviation Service Standards Activities (with and without charges), Schedule VI, lists the payment amount for the issuance of a certificate of approval for a maintenance organization.
- (a) Payment of the fee can be made online by going to the following link: Online Payment System.
- (b) Once the payment has been made a copy of the receipt will be sent via email.
4.2 Formal application phase
- (1) The applicant is required to send a copy of the receipt of fee payment, Form 24-0070, proof of the registered legal business name, and the proposed MPM to the applicable TCCA regional service centre for review.
- (2) Once the application is received, a CASI will be assigned to the company who will become the PMI of the organization.
4.3 Document evaluation phase
- (1) The PMI will review the submitted documents and inform the applicant if anything is incomplete or missing.
- (2) The PMI will assign an AMO number to the applicant which is required to be inserted into the MPM.
- (3) The PMI will carry out a thorough evaluation of the documents for compliance to the applicable regulatory requirements and inform the applicant of any discrepancies found.
4.4 Demonstration and inspection phase
- (1) Once the PMI is satisfied with the document evaluation, a meeting will be set up with the applicant to carry out an onsite inspection. The onsite inspection will verify that compliance with all the applicable requirements for certificate issuance have been implemented.
- (2) The following is a non-exhaustive list of items the PMI is required to verify to support the MPM:
- (a) Availability of or access to technical and regulatory documents to carry out maintenance per the scope of work;
- (b) Appropriate tooling, or access to appropriate tooling with a rental agreement relevant to the scope of work;
- (c) Appropriate procedures in place for the issuance of Aircraft Certification Authority (ACA) or Shop Certification Authority (SCA);
- (d) A facility, or an agreement to use a facility large enough for the work to be performed;
- (e) Appropriate facilities and equipment, or access to appropriate facilities and equipment;
- (f) Training files with appropriate training for employees and managers;
- (g) A QA program is in place;
- (h) An SMS program is in place (if appliable); and
- (i) Maintenance arrangements are completed correctly.
- (3) If any discrepancies are noted during the inspection, the applicant may be required to provide additional information, update the MPM, or update the application Form 24-0070.
4.5 Certification phase
- (1) Once the applicant has met all the conditions of issuance, the PMI will approve the MPM.
- (2) The PMI will sign and issue an AMO certificate with categories, ratings and limitations in accordance with Section 573.02 of the Standard.
- (3) The AMO certificate and approved MPM will then be sent to the applicant.
- (4) Once approved, TCCA will conduct scheduled surveillance to ensure the AMO’s continued compliance with TCCA regulations.
5.0 Application for a new Foreign AMO certificate
5.1 Pre-application phase
- (1) Application for a Foreign AMO must meet the requirements of Section 573.13 of the CARs.
- (2) AMO approvals will not be granted to foreign organizations where their facility is located in a state with whom Canada has entered into an agreement that provides recognition of such work. A listing of the current agreements and arrangements between Canada and other countries, regions, or governing bodies can be found at the following link: International agreements and arrangements.

(1) The applicant is required to demonstrate that issuing a Foreign AMO certificate is in the public interest of Canada. Examples of situations that are considered within the public interest are:
- (a) Where no other practical alternative exists, such as in the case where, due to local regulation, a state will not allow the extension of a Canadian AMO approval; and
- (b) Where the nature of the work is such that the expertise to perform the work is not available in Canada, or in a state with whom Canada has entered into an agreement that provides for recognition of such work.
Note: It is incumbent on the applicant to show that granting a foreign AMO approval is in the public interest, not merely in the interest of the applicant alone. Applications shall not be accepted from a foreign maintenance organization which is only seeking potential or future Canadian customers. Due to the financial implications placed on the Minister in respect to the issuance and surveillance of foreign AMO certificates, they will only be issued in rare cases.
- (2) The applicant should contact TCCA Standards Branch, Operational Airworthiness (OPAIR) (EXTTCCAOpAir-EXTTCACNavOp@tc.gc.ca).
- (3) Once the request has been initiated, the applicant is assigned an OPAIR CASI. The applicant is required to provide details on how they meet the requirements of paragraph 3 above. Once the applicant has demonstrated this, they can follow the standard application process starting from Section 4.1.2.
- (3) The applicant will be required to agree in writing to reimburse the Minister for expenses when carrying out any onsite inspections.
- (a) Prior to the onsite inspection, the applicant is required to sign Form 26-0622, Agreement for Recovering the Incremental Costs of Providing Services Inside / Outside Canada.
- (5) Foreign AMO certificates will be subject to a two (2) year expiry which is specified on the AMO certificate.
5.2 Application for re-issue of a Foreign AMO certificate
- (1) A Foreign AMO is required to apply for re-issue of their AMO certificate every two (2) years. It is the responsibility of the certificate holder to initiate the re-issue process 120 days before the expiry.
- (2) The Foreign AMO will be required to apply as if it is an initial application for each re-issue. Refer to Section 5.1.
6.0 Application for AMO certificate amendment
6.1 Pre-application phase
- (1) It may be necessary for an AMO to add or remove categories, ratings or limitations on their certificate based on customer or operational needs.
- (2) The AMO is required to complete Form 24-0070. The AMO may refer to the detailed instructions to complete each field of Form 24-0070. In addition, the applicant may refer to Appendix A – Guidance for completing Form 24-0070 for examples of ratings and limitations in reference to a category.
- (3) The AMO is required to revise their MPM in accordance with all changes requested.
6.2 Formal application phase
- (1) Send the completed Form 24-0070, the associated fee, and the amended MPM to the AMO’s TCCA regional service centre with carbon copy (cc) to their PMI.
6.3 Document evaluation phase
- (1) The PMI will carry out a thorough evaluation of the submitted documents for compliance to the applicable regulatory requirements and inform the AMO of any discrepancies found.
6.4 Demonstration and inspection phase
- (1) When the PMI is satisfied with the MPM there may be a requirement for an onsite inspection of the facility. This will be at the discretion of the PMI. If the amendment request does not require an onsite inspection the PMI may request compliance digitally via email.
- (2) The following is a non-exhaustive list of items the PMI may verify to support the MPM amendment:
- (a) Technical and regulatory documents to carry out maintenance per the scope of work;
- (b) Appropriate tooling or access to appropriate tooling with a rental agreement relevant to the scope of work;
- (c) Appropriately rated ACA or SCA holders for the scope of work;
- (d) A facility, or an agreement to use a facility large enough for the work to be performed;
- (e) Appropriate facilities and equipment or access to appropriate facilities and equipment; and
- (f) Training files with appropriate training for employees and managers.
- (3) If any discrepancies are noted during the inspection, the applicant may be required to provide additional information, update the MPM, or update the Form 24-0070.
6.5 Certification phase
- (1) Once the AMO has met all the regulatory requirements, the PMI will approve the MPM.
- (2) The PMI will issue an amended AMO certificate with categories, ratings and limitations in accordance with Section 573.02 of the Standard.
- (3) The AMO certificate and approved MPM will then be sent to the certificate holder.
7.0 AMO change of ownership
- (1) Depending on the change, an amendment to a certificate or an application for a new certificate may be required. In other cases, only an MPM amendment is required. The scenarios are as follows:
- (a) When the ownership of an AMO changes there may be an associated change to the legal name and trade name (if applicable) that was identified on the initial application form 24-0070. If the name of an applicant changes due to the sale of the organization, then a new AMO certificate and approval number will need to be issued.
- (b) When a new corporation purchases all the assets of an existing AMO certificate holder, the new corporation is required to apply for a new AMO certificate, as the new corporation is a separate legal entity form the existing AMO certificate holder and the AMO certificate does not follow the assets.
- (c) When federally incorporated businesses amalgamate into a combined or merged entity and one of them holds an AMO certificate, the new entity may continue to hold the certificate as it is considered a continuation of the combined entities. In this scenario an application for a new AMO certificate would not be required.
- (d) In the case of a share purchase agreement, there is no change in the legal entity holding the AMO certificate and therefore the acquisition does not affect the terms on which the certificate was issued. In this scenario an application for a new AMO certificate would not be required.
- (e) If a condition of issuance within CAR 573 changes, i.e., management personnel, category, rating, limitation, legal name or address change, these will be considered administrative changes within CAR 573 and the AMO certificate number will not need to change. However, it is understood that an amendment to the AMO certificate may be required, as well as an amendment to the MPM as necessary.
- (2) In any scenario it is important to contact the organization’s PMI so they are aware of any changes, and the PMI can then answer any questions the AMO may have regarding the change of ownership.
