Whereas the Maintenance Control Manual of a Canadian Air Operator has been amended and approved by the Minister allowing them to include tasks in their Maintenance Control Manual identified in Airworthiness Directive of the Federal Aviation Administration (FAA) AD 2005-21-02, this exemption permits Canadian air operators and its flight crew members to perform without requiring a maintenance release, tasks that are identified in airworthiness directive FAA AD 2005-21-02 and within the flight crew member’s capacity to perform, but are not enumerated in the elementary work listings set out in the Aircraft Equipment and Maintenance Standards.

In the majority of cases throughout the CARs and related standards, the term “manufacturer” is used when in fact “type certificate holder” is implied. Thus, the purpose of this exemption is to exempt a person who manufactures an aircraft, a person who owns an aircraft that obtains an authorization to attach an aircraft identification plate or a person who operates an aircraft in flight from paragraph 201.01(4)(a) of the CARs. This exemption is implementing the regulatory intent of NPA 2004-087. By doing so, the administrative burden of having to re-identify the manufacturer (currently defined as being the holder of a type certificate for an aeronautical product) on the aircraft identification plate upon change of type certificate ownership or upon a request to install an aircraft identification plate, is alleviated. This exemption also permits aircraft identification plates for new aircraft to be marked with the name of the “maker of the aeronautical product” in lieu of the holder of the aircraft type certificate.

Standard 573.02(11) states that an AMO with ratings in the aircraft avionics, engine, propeller, structure, or component categories may evaluate undocumented parts of the kinds listed on the pertinent ratings, provided that: (amended 2002/03/01: previous version) (a) the AMO establishes applicable procedures, in its MPM, to perform the process outlined in Standard 571, Appendix H; (b) the AMO obtains approval for the procedures required in paragraph (a) in accordance with section 573.01 of the CARs, and (c) the performance of such service is authorized in the limitations set out in the AMO certificate.
