(hereinafter “the Operator”) to develop, test, evaluate, and certify an infrared visual aid, the Bombardier Enhanced Flight Vision System (EFVS), which is displayed on the Head Up Display (HUD). This exemption is required to allow the Operator’s PICs for the purpose of flight testing and operational evaluation, of aircraft under IFR conditions, to descend below the Decision Height (DH) when conducting a CAT I precision approach and below the Minimum Descent Altitude (MDA) when conducting a non-precision approach to 100 feet Height Above Touchdown (HAT) Zone Elevation, or to commence an IFR approach if the reported RVR “A” or “B”, if measured for the runway in use is below 1,200 feet, when using an EFVS to acquire the required visual references.

The purpose of this exemption is to: • provide more flexibility to the air operators and flight crew members conducting on-demand non-scheduled air transport services under Subpart 704 or 705 of the CARs when no other pilot is available. This exemption will permit an increase of hours above the flight time limitations of paragraphs 700.15(1)(b), (c) and (d) of the CARs, as set out in the conditions of this exemption. These limits can only be extended for on-demand non-scheduled flight time that occur after the pilot has reached the limit prescribed in the CARs; • also, this exemption permits these air operators to use, in addition to the two scheduling schemes described under paragraph 700.19(1)(a) of the CARs, a scheduling scheme of one period of at least 48 consecutive hours of time free from duty, within each 12 consecutive days. • this exemption will enable air operators and flight crew members, conducting on-demand non-scheduled air transport services under Subpart 704 or 705 of the CARs, to better meet the variable and unpredictable demands associated with this type of operation.

This exemption allows NAV CANADA as holder of an ATS operations certificate to provide air traffic services at specific operational locations under specific conditions. This exemption allows NAV CANADA air traffic controllers to issue an air traffic control clearance or an air traffic control instruction in the case of domestic airspace in accordance with specific conditions rather than meeting the requirements set out in Subsection 1.1 Chapter 1 of the Canadian Domestic Air Traffic Control Separation Standards. This exemption allows NAV CANADA air traffic controllers to apply visual separation in accordance with specific conditions at specified airports for which NAV CANADA has conducted an implementation safety assessment for the introduction of visual separation for IFR departing aircraft and has obtained approval by the Director, Standards, Transport Canada Civil Aviation (TCCA). It also allows NAV CANADA air traffic controllers to assign visual separation responsibility to a pilot of successive IFR aircraft departing from the same, intersecting, non-intersecting and parallel runways at specific airports and in accordance with specific conditions.
