The purpose of this exemption is to: ·Allow AES to have operational control of two Mi-26T helicopters, without the aircraft having a Canadian type certificate. The two aircraft will be added to the types authorized on AES's 702 and 703 Air Operators Certificates, however, the aircraft will remain registered in Russia and will remain in the legal custody and control of UTair Aviation, a Russian company; ·Allow AES to permit UTair Aviation to perform maintenance on the two Mi-26T helicopters when performance of the maintenance by UTair Aviation has not been approved by the Minister as being in conformity with the CARs; ·To allow AES to conduct the operations described above in a manner that will take advantage of the unique lifting capabilities of the Mi-26T helicopter without adversely affecting commercial operations utilizing Canadian Type Certificated aircraft. ·To allow AES to utilize the MI 26 helicopter to transport equipment, required by the Canfor Lumber Mill in Fort Nelson, between Vanderhoof and Fort Nelson British Columbia, with intermediate stops as required.

The purpose of this exemption is to allow Air Canada and their A330 and A340 qualified pilots operating both aircraft types under a MFF program to maintain their currency qualifications, on both the Airbus A330 and the Airbus A340 aircraft types by considering take-offs, landings and sectors on one type to provide the same currency qualifications on the other type. This exemption also will allow Air Canada and their A330 and A340 qualified pilots to complete a pilot proficiency check (PPC) and line check on either the Airbus A330 or Airbus A340 aircraft type and be deemed to have met the PPC requirements and line check requirements for the other aircraft type, in accordance with the CASS. For the purpose of this exemption, "Mixed Fleet Flying" is operation of a base aircraft and one or more variants of the same type, common type, related type or a different type by one or more flight crewmembers, between training or checking events.

The purpose of this exemption is to permit pilots-in-command of IFR aircraft operated by private operators pursuant to Subpart 604 of the CARs, Canadian operators of state registered aircraft operating under an exemption issued by the Minister of Transport to Section 604.03 of the CARs or by air operators pursuant to Part VII of the CARs to descend below the minimum descent altitude (MDA), when conducting a NPA, even if the required visual reference necessary to continue the approach to land has not been established. This exemption is required in order to accommodate the altitude loss below MDA that will likely occur during a missed approach, following a stabilized constant descent angle (SCDA) NPA.

Paragraph 704.26(1)(b) of the CARs prohibits the conduct of a take-off in an aircraft in IMC where weather conditions are at or above the take-off minima, but below the landing minima, for the runway to be used, if the person is authorized to do so in an air operator certificate and the person complies with the CASS. Paragraph 704.26(3)(b) of the CARs permits a person to conduct a take-off in an aircraft in IMC where weather conditions are below the take-off minima specified in the instrument approach procedure, if the person is authorized to do so in an air operator certificate and the person complies with the CASS. The purpose of this exemption is to allow the air operator, Exploits Valley Air Services Ltd., to depart from St. John's Newfoundland using the Deer Lake, Newfoundland or the Stephenville, Newfoundland airports as takeoff alternates, when the weather at Gander, Newfoundland airport is not suitable for it to be used as a take-off alternate, without having to meet the requirements of paragraphs 704.26(l)(b) and 704.26(3)(b) of the CARs and clause 724.26(1)(b)(i)(A) of the CASS, in accordance with the application, below.
