Paragraph 705.34(1)(a) of the CARs prohibits the conduct of a take-off in a twin-engined aircraft in IMC where weather conditions are at or above the take-off minima, but below the landing minima, for the runway to be used, unless an alternate aerodrome is specified in the operational flight plan and that aerodrome is located within the distance that can be flown in 60 minutes at the one-engine-inoperative cruise speed. Paragraph 705.34(3)(b) of the CARs permits a person to conduct a take-off in an aircraft in IMC where weather conditions are below the take-off minima specified in the instrument approach procedure, if the person is authorized to do so in an air operator certificate and the person complies with the CASS. The purpose of this exemption is to allow the air operator, Labrador Airways Limited, to depart from St. John’s Newfoundland using the Deer Lake, Newfoundland or the Stephenville, Newfoundland airports as takeoff alternates, when the weather at the Gander, Newfoundland airport is not suitable for it to be used as a take-off alternate, without having to meet the requirements of paragraphs 705.34(1)(a) or 705.34(3)(b) of the CARs and subparagraph 725.34(1)(b) or subparagraph 725.34(2)(b)(i) of the CASS, in accordance with the application, below.

The purpose of this exemption is to allow air operators who are eligible to operate a SAS in Canada under the NAFTA to conduct aerial work in Canada under the authority of a Foreign Air Operator Certificate - Free Trade Agreement (FAOC-FTA) rather than an authorization or air operator certificate as required by section 700.03 of the CARs. Canada, the United Mexican States and the United States of America ratified the NAFTA on January 1, 1994. The intent of the agreement, among other things, is to promote cross-border trade of SAS amongst the signatories of the Agreement. "Specialty Air Services" is defined in Article 1213 of the NAFTA to include aerial mapping, aerial surveying, aerial photography, forest fire management, fire fighting, aerial advertising, glider towing, parachute jumping, aerial construction, heli-logging, aerial sightseeing, flight training, aerial inspection and surveillance, and aerial spraying services and to exclude air carrier transportation. Government officials from the three countries established the Trinational Specialty Air Services Steering Committee and Working Groups to discuss standards and regulations pertaining to SAS with a view to commencing an implementation process whereby SAS operations could be facilitated. The Trinational Specialty Air Services Steering Committee and Working Groups adopted an agreement as to equivalent level of safety shared by all parties and designed new standards and procedures which are found in the NAFTA SAS, Phase II Report.

The purpose of this exemption is to allow Chilean air operators who are eligible to operate a SAS in Canada under the CCFTA to obtain an air operator certificate to conduct aerial work in Canada without having to be a citizen, permanent resident, or corporation of the United States of America or Mexico, or a signatory of the NAFTA. The CCFTA was ratified by Canada and Chile on June 1, 1997. The intent of the agreement, among other things, is to promote cross-border trade of SAS amongst the signatories of the Agreement. “Specialty Air Services” is defined in Article H-12 of the CCFTA to mean aerial mapping, aerial surveying, aerial photography, forest fire management, fire fighting, aerial advertising, glider towing, parachute jumping, aerial construction, heli-logging, aerial sightseeing, flight training, aerial inspection and surveillance, and aerial spraying services. Where aircraft are being operated using the single-pilot Instrument Flight Rules (IFR) authority of Section 703.86 of the CARs, the situation arises where the required auto-pilot becomes unserviceable and the aircraft then requires two pilots and hence, a CVR. The purpose of this exemption is to allow Canadian air operators and flight crew members who operate multi engined, turbined-powered aircraft under the single-pilot IFR authority Section 703.86 of the CARs to continue to operate for a maximum period of 90 days without a CVR following the failure of the auto-pilot.

Subsection 602.128(1) of the CARs, which comes into force on December 1, 2006, states that no pilot-in-command of an IFR aircraft shall conduct an instrument approach procedure except in accordance with the minima specified in the Canada Air Pilot or the route and approach inventory. The normal minimum RVR requirement is 1200 feet RVR. Subsection 704.36(1) of the CARs, which comes into force on December 1, 2006, states that no person shall conduct a CAT II or CAT III precision approach unless the air operator is authorized to do so in its air operator certificate and the approach is conducted in accordance with the Manual of All Weather Operations (Categories II and III). Section 700.11 of the CARs states that no pilot in command of an IFR aircraft operated under this Part who is conducting a CAT II or CAT III precision approach shall continue the approach beyond the FAF inbound or, where there is no FAF, the point where the final approach course is intercepted, unless the RVR is equal to or greater than the minimum RVR specified in the Canada Air Pilot in respect of the runway or surface of intended approach for the instrument approach procedure conducted. The purpose of this exemption is to allow Cougar Helicopters Inc. pilots-in-command of the Eurocopter S332 and Sikorsky SK92 helicopter types to conduct Category II Instrument Landing System (ILS) approaches that are published in the Canada Air Pilot, when the reported visibility is at least Runway Visual Range (RVR”A”) of 600 feet, using a decision height (DH) of 100 feet.
