Part 3 – Division 6
Clause-By-Clause
Airport Information Provision
Clause 1
This clause adds section 50.2 to the Canada Transportation Act, which requires the owner or operator of an airport or other aviation facility, and individuals or entities whose activities may affect the value of an airport or other aviation facility or of the owner or operator of the airport or other aviation facility, to provide information to the Minister upon request.
The intent of this clause is to enable the Minister to obtain information necessary to exercise the Minister’s powers or perform the Minister’s duties and functions under the Canada Transportation Act or any other Act of Parliament or for the development of transportation policies, including information regarding the assessment of the value of an airport or other aviation facility, or the owner or operator of the airport or other aviation facility and information respecting the capacity and development of the national air transportation system.
Clause 2
This clause amends subsection 51(2) of the Canada Transportation Act, by adding paragraph (a.11) which provides that, while the information provided under section 50.2 is confidential, the Minister may communicate it to Crown corporations and individuals or entities that advise or are consulted by the Minister in relation to the development of transportation policies. This clause is intended to supplement existing provisions relating to information disclosure to ensure that the Minister can disclose information obtained under the preceding clause to Crown corporations, advisors, and consultants, for the purposes of developing transportation policies.
