Administrative Monetary Penalties

The Marine Transportation Security Act (MTSA) gives Transport Canada Marine Security officials authority to issue Administrative Monetary Penalties (AMPs) to companies and individuals who violate the MTSA and the Marine Transportation Security Regulations (MTSR), security measures and directions.

The Marine Security Program works collaboratively with industry stakeholders to ensure a common understanding of MTSA/MTSR requirements and how to achieve compliance.

Administrative Monetary Penalties represent one enforcement option in circumstances in which it becomes clear that compliance with the MTSA and/or MTSR is not being achieved on the part of industry stakeholders. The issuance of AMPS, however, is not the first step in achieving regulatory and/or legislative compliance and is one aspect of the Program’s graduated approach to achieving compliance.

The Marine Security Program is currently working on proposed Marine Security Administrative Monetary Penalties Regulations that will also apply to the Domestic Ferries Security Regulations.
