Order under Section 32.01 of the Railway Safety Act due to COVID-19, No. 22

Whereas the World Health Organization has characterized COVID-19 as a pandemic and that pandemic is affecting Canada;

Whereas, pursuant to section 45 of the Railway Safety ActFootnote a, the Minister of Transport has, in writing, authorized the Director General, Rail Safety, to make an order under section 32.01Footnote b of that Act;

Whereas, pursuant to section 32.01 of the Railway Safety Act, if the Minister considers it necessary in the interests of safe railway operations, the Minister may, by order sent to a company require the company to stop any activity that might constitute a threat to safe railway operations or to follow the procedures or take the corrective measures specified in the order;

Whereas ministerial orders 21-07.3 and 21-09.2, issued pursuant to section 32.01 of the Railway Safety Act, included requirements related to verifying proof of vaccination for passengers and employees;

Summary

Non-Destructive Testing (NDT) techniques are often used to identify flaws during routine tank car inspections. One technique known as Alternating Current Field Measurement (ACFM) is being proposed for use by tank car manufacturers for inspection purposes.

1. Scope

This subpart prescribes minimum requirements for the frequency and manner of inspecting track to detect deviations from the TSR.

This Subpart prescribes minimum requirements for certain track appliances and track-related devices.

II. Derails

Each derail must be clearly visible. When in a locked position a derail must be free of any lost motion which would allow it to be operated without removing the lock.
