ON-009-2017 The purpose of this exemption is to: a) allow and authorize Helicopter Transport Services (Canada) Inc. (HTSC) to operate in Canadian airspace one or more Sikorsky CH54B helicopters, which are registered in the United States of America (USA) and which do not have a certificate of airworthiness that meets the requirements of Article 31 of the Convention, in aerial construction in support of the Bipole III HVDC power line construction project in Manitoba, without: i) an authorization required by and issued pursuant to section 203.03 of the CARs; ii) an authorization required by paragraph 700.05(1)(b) of the CARs; and iii) an authorization required by paragraph 700.05(3)(b) of the CARs; b) allow and authorize HTSC to permit Helicopter Transport Services, a US subsidiary of HTSC, to perform maintenance on the CH54B helicopters where the Minister has not approved the arrangement pursuant to paragraph 706.09(1)(c) of the CARs; and c) allow HTSC to operate in Canada helicopters that are registered in a foreign state that have been present in Canada for a total of 90 days or more in the immediately preceding twelve-month period when the operator of the helicopters is not an entity that is incorporated or otherwise formed under the laws of a foreign state, as required by subparagraph 202.42(1)(b)(iii) of the CARs. |

NCR-017-2017 Current paragraph 723.22(1 )(a) of the CASS permits only factory built single engine turbine powered aeroplanes to transport passengers at night Visual Flight Rules (VFR) or in Instrument Flight Rules (IFR) condition. (This air transport service is abbreviated as Single-Engine Instrument Flight Rules (SEIFR) in this exemption). This regulation has proven to be very restrictive and specific in its application. It disqualifies the same factory built single engine turbo-prop aeroplane retrofitted with a better performing turbo-prop engine from being given SEIFR authority. This exemption provides relief from this regulation by granting SEIFR authority to Canadian air operators to operate Cessna Caravan model 208 and 208B aeroplanes retrofitted with Honeywell TPE33I-I2JR turboprop engine in accordance with the Federal Aviation Administration (FAA) Supplemental Type Certificates (STC) SA0229 1AK or SA 10841 SC (see Appendix B and C respectively) and in full compliance with the conditions set out below. |
