NCR-013-2017 The purpose of this exemption is to permit Bombardier to obtain an amended type certificate to include a new aeroplane model BD-700-2A12 (Global 7000), which contains design features that do not fully comply with the applicable standards of airworthiness for “Emergency Exit Arrangement” in accordance with paragraph 525.809(a) of the AWM [Change 525-22]. In particular, this exemption is intended to provide relief from paragraph 525.809(a) of the AWM requirements in the following three scenarios: (a) in the case of the flight crew emergency overhead exit (hatch), where due to fuselage curvature the path from the exit to the ground contact point is not a straight line, a viewing means with the exit closed is not required to be capable to permit viewing of the likely areas of evacuee ground contact during all lighting conditions with the landing gear extended, as well as in all conditions of landing gear collapse; (b) in the case of a non-overwing passenger exit, a viewing means with the exit closed in not required to permit viewing of the likely areas of evacuee ground contact during all lighting conditions with the landing gear in all conditions of collapse; and (c) in the case of an overwing passenger exit, it is not required for a person to be able to view the likely areas of evacuee ground contact while in a position to open the exit.

QC-005-2018 - cancels NCR-036-2014 CANCELLED - REPLACED BY QC-008-2019 The purpose of this exemption is to permit Bombardier Inc. (hereinafter “the Operator”) to develop, test, evaluate, and certify an infrared visual aid, the Bombardier Enhanced Flight Vision System (EFVS), which is displayed on the Head Up Display (HUD). This exemption will allow Bombardier Inc. PICs, for the purpose of flight testing and operational evaluation of aeroplanes when operating under IFR conditions: 1) to descend below the Decision Height (DH) when conducting a CAT I precision approach and below the Minimum Descent Altitude (MDA) when conducting a non-precision approach to touchdown; 2) to commence an IFR approach if the reported RVR “A” or “B”, when measured for the runway in use is below 1,200 feet, and; 3) to acquire the required visual references and to take off when reported RVR is at least 600 feet or at least ¼ statute mile, if RVR is not available when low visibility procedures are in effect when using an EFVS instead of natural vision.

OTT-010-2018 - Cancels NCR-073-2015 The purpose of this exemption is to allow Jazz when operating under Subpart 5 of Part VII of the CARs to permit the use of Wi-Fi Onboard Connectivity and connection to Bluetooth devices on board its Bombardier CL-600-2D15 (CRJ705) and Bombardier CL-600-2D24 (CRJ900) aeroplanes equipped with a broadband services system produced by AirCell Broadband Services (ABS) GoGo Wi-Fi System during cruising phase of flight and once the aeroplane is operating at or above 10,000 feet ASL. The Jazz GoGo Internet service will enable the use of Wi-Fi capable for transmitting portable electronic devices (TPEDs). This will allow the use of TPEDs for surfing the web, checking emails and doing instant messaging by means of transmitting and receiving signals.

OTT-006-20189 The purpose of this exemption is to allow Swoop Inc, when operating under Subpart 705 of the CARs, to permit, during all phases of flight, the use of Wi-Fi onboard connectivity onboard its Boeing 737-800 aeroplanes that are equipped with a broadband services system. The Wi-Fi onboard connectivity service produced by Panasonic will enable the use of transmitting portable electronic devices (PEDs) to access the internet, check emails and use instant messaging by means of transmitting and receiving signals over the Wi-Fi connectivity. The broadband service system, provided by Panasonic will allow the streaming of content to portable electronic devices during the flight offering passengers with video and audio content that they can receive on their own device by means of transmitting and receiving signals over the Wi-Fi onboard connectivity service.

As at the time of drafting this exemption TCCA is aware after the aircraft arrives in Canada its custody and control will be transferred to Air Canada Rouge who will then become the registered owner. With this in mind and to minimize any potential confusion as to which entity will be responsible for fulfilling the attached conditions, the decision was made to impose the required conditions attached to the exemption upon the “registered owner” of the aircraft. As at the time of drafting this exemption TCCA is aware after the aircraft arrives in Canada its custody and control will be transferred to Air Canada Rouge who will then become the registered owner. With this in mind and to minimize any potential confusion as to which entity will be responsible for fulfilling the attached conditions, the decision was made to impose the required conditions attached to the exemption upon the “registered owner” of the aircraft.

NCR-004-2018 The purpose of this exemption is to allow all air traffic controllers working for NAV CANADA to issue an air traffic control clearance or an air traffic control instruction in the case of domestic airspace at specific operational airports under specific conditions rather than meeting the requirements set out in subsection 1.1 Chapter 1 of the Canadian Domestic Air Traffic Control Separation Standards (Standard 821). This exemption allows NAV CANADA air traffic controllers to apply visual separation in accordance with specific conditions at specified airports for which NAV CANADA has conducted an implementation safety assessment for the introduction of visual separation for IFR departing aircraft and has obtained approval from Transport Canada Civil Aviation, Chief, Air Navigation Services, National Operations. It also allows NAV CANADA air traffic controllers to assign visual separation responsibility to a pilot of a successive IFR aircraft departing from the same, intersecting, non-intersecting and parallel runways at specific airports and in accordance with specific conditions.
