Important Changes to Safety Standards Pertaining to Containers for Dangerous Goods Transport following the publication of the Regulations Amending the Transportation of Dangerous Goods Regulations (International Harmonization Update, 2016)

On July 12, 2017, an amendment entitled Regulations Amending the Transportation of Dangerous Goods Regulations (International Harmonization Update, 2016) was published in Part II of the Canada Gazette. The amendment is accessible through the following URL: Amendment SOR/2017-137.

This amendment introduces ambulatory references (also known as “dynamic references”) in the Transportation of Dangerous Goods Regulations (TDGR) to allow stakeholders to use the most recent versions of certain international codes and safety standards for means of containment. The main driver for this change is to increase efficiency and eliminate the burden associated with having to be in compliance with both current international and outdated domestic regulations.

The 14 technical standards listed below will be dynamically incorporated in the TDGR :

When will the regulated community be required to formally adopt the dynamically-referenced standards?

It is a two-fold process:

  1. There is a 6-month transition period, beginning on July 12, 2017, to comply with the most recent versions of the 14 Canadian General Standards Board (CGSB) and Canadian Standards Association (CSA) standards that are now dynamically referenced in the TDGR . During this period you may either comply with the latest version of the standard or with the version that was referenced in the TDGR on the day before the amendment was published. After this period, you must comply with the most recent version.
  2. In the future, whenever a new edition of a dynamically-referenced standard is published, you will have 6 months from the day the revised standard is published to comply. You can voluntarily comply with new requirements once a standard is published.

It is the responsibility of container facilities and other stakeholders to read and understand the sections of the standard that are applicable to their respective activities, to ensure that they are aware of all the changes.
