ISSUE
Cruise Ships, Cruise Ship Tenders And Cruise Ship Terminal - 100% Screening At All MARSEC Levels
Purpose:
To remind cruise ship and marine facility operators of the requirements and shared responsibilities of a cruise ship and a cruise ship terminal with respect to the 100% screening of each person and all their goods. This includes but is not limited to carry-on baggage and checked baggage in accordance with the Marine Transportation Security Regulations and the Cruise Ship and Cruise Ship Terminal Security Measure.
Cruise ships and cruise ship terminal operators are also reminded that in accordance with Marine Security Operations Bulletin 2012-003, cruise ship tenders, as an extension of the cruise ship, are also required to comply with these requirements.
Directive:
Vessel and marine facility operators, Company Security Officers, Vessel Security Officers, Marine Facility and Port Security Officers are reminded in accordance with the Marine Transportation Security Act (MTSA) and the Marine Transportation Security Regulations (MTSR), of the following definitions:
“cruise ship” means a vessel to which Part 2 applies and that has sleeping facilities for over 100 persons who are not crew members, but does not include a ferry (MTSR interpretation section);
“marine facility” in the context of a cruise ship includes an area of land, water, ice or other supporting surface used, designed, prepared, equipped or set apart for use, either whole or in part, for the arrival, departure, movement or servicing of vessels, including buildings, installations, and equipment associated with it. (For a complete definition of “marine facility” please reference the MTSA interpretation section.); and
“cruise ship terminal” means a marine facility that interfaces with cruise ships.” (MTSR interpretation section).
Cruise ship and cruise ship terminal operators must comply with the MTSA and all of the applicable sections of the MTSR. This includes MTSR sections 261 to 265 for cruise ships and section 348 for cruise ship terminal operators. Additionally, cruise ships and cruise ship terminal operators must comply with the “Cruise Ship and Cruise Ship Terminal Security Measure” as applicable.
At all MARSEC levels, regardless of whether or not the screening is conducted on shore or on the vessel, each cruise ship operator subject to the MTSR is responsible to ensure that 100% screening of each person and all their goods is carried out including but not limited to carry-on baggage and checked baggage. This is to ensure that no person possesses or carries weapons, explosives or incendiaries on board a cruise ship.
All cruise ship and cruise ship terminal security plans, as appropriate, must include procedures to ensure that all of the applicable requirements of the MTSR are implemented and to ensure 100% screening of each person and all their goods is carried out. This includes but not limited to carry-on baggage and checked baggage.
Consequently, vessel and marine facility operators are required to provide every person the support needed to fulfil their responsibilities (MTSR 205.(b) and 303(b)). Furthermore in accordance with the MTSR sections 209.(j) and 212.(h), the Company Security Officer and the Vessel Security Officer are responsible for ensuring vessel personnel receive appropriate security training; this includes the training required for the screening of persons and all their goods.
Marine Facility Security Officers are responsible (MTSR 306(i)) to ensure appropriate security training is provided to personnel at the marine facility.
Training records are also required to be kept and maintained by the Vessel Security Officer and the Marine Facility Security Officer (MTSR 218(1)(a) & 312(1)(a)).
All of the above responsibilities that are applicable to foreign flagged vessels while operating in Canada are referenced within the MTSR sections 203(3)(a) and 203(4)(a) as well as under the ISPS Code as incorporated within the MTSR sections 203(3)(b) and 203(4)(b). This is in addition to the applicable requirements prescribed in the Cruise Ship and Cruise Ship Terminal Security Measure.
